Landlords must make a written offer to tenants to report their positive rental payment information to at least one nationwide consumer reporting agency, with the offer provided at lease signing and annually thereafter

Tenants may opt in at any time and can later opt out, but must wait at least 6 months before resuming reporting after opting out or failing to pay the reporting fee

Landlords may charge tenants a fee for reporting capped at the lesser of actual cost or $10 per month; if there is no actual cost, no fee may be charged

Failure to pay the reporting fee cannot result in eviction, security deposit deductions, or negative credit reporting, but landlords may stop reporting after 30 days of non-payment

Exempts landlords with 15 or fewer units unless they own multiple rental properties and are a REIT, corporation, or LLC with a corporate member; effective July 1, 2025
