Expands the list of misdemeanor charges that disqualify defendants from preprosecution diversion programs, adding violations of domestic violence protection orders, harassment, stalking, coercion, and vehicular manslaughter

Excludes from diversion eligibility defendants with prior convictions for felonies, gross misdemeanors, domestic violence offenses, violent or sexual offenses, DUI, or attempts to commit certain serious crimes

Clarifies that district courts, justice courts, and municipal courts each have authority to establish substance use disorder treatment programs

Allows courts to provisionally refer defendants to substance use treatment programs while awaiting completion of clinical or substance use assessments

Becomes effective upon passage and approval
