Principals may suspend homeless or foster care pupils for more than 5 days, but must hold a meeting within 10 school days to determine whether the behavior was caused by or substantially related to the pupil's housing status

If behavior is linked to homelessness or foster care, the principal must either end the suspension and provide behavioral/academic support, or assign the pupil to a temporary alternative placement for up to 45 school days

Temporary alternative placements may be extended beyond 45 days if the principal determines continued placement is necessary for safety, requiring targeted interventions and notification of special education evaluation rights

Before deeming a homeless or foster care pupil a habitual disciplinary problem, principals must conduct a formal meeting (rather than just consult) with the local homeless liaison, school contact person, and the court-appointed educational decision maker for foster youth

Effective July 1, 2025, with local governments exempt from unfunded mandate requirements for implementation costs
