Cities, counties, unincorporated towns, general improvement districts, wastewater districts, and water authorities must notify the Division of Environmental Protection when they become aware of sewage, industrial waste, or unauthorized discharges into state waters

Division of Environmental Protection must notify any Indian tribe that may be affected by a reported discharge, following Department of Native American Affairs policy

Indian tribes may request public records from state and local government entities regarding water discharge incidents or water treatment policies

Local governments and water authorities are prohibited from entering contracts that would prevent sharing water-related information with Indian tribes, though attorney-client privilege is preserved

Violations subject to existing water pollution enforcement provisions, including civil penalties up to $25,000 per day and criminal penalties of up to $10,000 fine and/or 364 days imprisonment for false statements; applies to contracts entered on or after October 1, 2025
