Federal agencies claiming vested water rights are exempted from the December 31, 2027 deadline to submit proof of claims to the State Engineer, which applies to all other claimants whose claims are otherwise deemed abandoned if not filed by that date.

Beginning January 1, 2028, notices of pending water rights adjudication must require federal agencies to prove both reserved and vested water rights claims, expanding the current requirement that only addresses reserved rights.

The State Engineer must mail or deliver notice to federal agencies at least 30 days before taking proofs begins, with a minimum 60-day window for filing proofs after commencement.

Section 1 (federal agency exemption) takes effect upon passage and approval; Section 2 (revised notice requirements) takes effect January 1, 2028.
