Private health insurers will be prohibited from requiring step therapy before covering FDA-approved drugs that prevent HIV acquisition or treat HIV or hepatitis C, effective January 1, 2027

Public Employees' Benefits Program and Medicaid managed care organizations may continue using step therapy as a medical management technique for these same drugs

Applies to individual health insurance, group health insurance, health benefit plans, fraternal benefit societies, hospital/medical service corporations, health maintenance organizations, and managed care organizations

Insurers remain prohibited from using other medical management techniques (prior authorization, formulary restrictions) on HIV prevention, HIV treatment, and hepatitis C treatment drugs

Provisions become effective upon passage for regulatory preparation, with full implementation on January 1, 2027
