Autonomous vehicles exceeding 26,000 pounds gross vehicle weight rating require a human operator with a commercial driver's license present in the vehicle, trained in operating and shutting off the vehicle, and capable of taking immediate manual control during system failures or emergencies

Autonomous vehicles with more than two axles capable of transporting 8 or more passengers must have a CDL-holding human operator present who meets the same training and manual control requirements

Human operators in these heavy and passenger-capacity autonomous vehicles must comply with all federal and state qualifications for the vehicle type, whether operating in automated or non-automated mode

Provisions take effect October 1, 2025 and expire by limitation on September 30, 2035 (10-year sunset)
