Cities and counties within regions governed by interstate compact regional planning agencies (currently the Lake Tahoe region) may impose linkage fees on developers when the regional plan supports affordable housing development through linkage fees and deed restrictions

Linkage fees apply to new residential units of 1,000+ square feet, additions of 750+ square feet to existing units, and remodeling projects valued over $100,000

Fee revenue must fund affordable housing units no larger than 1,000 square feet that are deed-restricted for sale or rental as affordable housing, and can offset utility hookup costs and impact fees

Developments of affordable housing units and accessory dwelling units with deed restrictions for affordable housing are exempt from the linkage fee

Local government authority under this provision remains subordinate to regional planning agency powers and cannot conflict with regional plans or ordinances
