Prohibits commercial fishing vessels longer than 70 feet in registered length from taking food fish, shellfish, or crustacea from New York marine and coastal district waters.

Exempts vessels that were actively used for commercial fishing prior to July 1, 1997 from the 70-foot length restriction, with the Department to publish and maintain a list of such exempt vessels.

Allows exempt vessels on the Department's list to be replaced one time without losing their exemption status.

Permits commercial fishing vessels of 63 feet or greater registered length to be replaced one time with a new vessel up to 10 percent larger in registered length.

Takes effect immediately upon enactment.
