Establishes that the state energy conservation construction code must meet or exceed ASHRAE 90.1-2007 for commercial buildings and the most recent International Energy Conservation Code for residential buildings, or achieve equivalent energy savings.

Applies the energy code to new building construction, additions, and alterations to existing buildings, while providing specific exemptions for limited renovations that do not increase energy use (storm windows, glass replacements, reroofing without cavity exposure, etc.).

Requires the State Fire Prevention and Building Code Council to consider cost effectiveness based on whether materials and installation costs equal or are less than the present value of energy savings over a ten-year period.

Mandates that local governments enforce the state energy conservation construction code and establishes minimum training, inspection frequency, and compliance measurement standards for code administration and enforcement personnel.

Provides that municipalities may adopt local energy codes more stringent than the state code, including mandatory energy efficiency testing and ratings, if filed with the state council within thirty days.

Takes effect January 1, 2011, with provisions allowing the state fire prevention and building code council and secretary of state to adopt implementing regulations prior to that date.
