Requires employers operating schools serving children under age 16 to check the sex offender registry before hiring prospective employees for positions involving direct and unsupervised contact with children.

Mandates employers inform prospective employees that a sex offender registry inquiry will be performed before initiating the check.

Establishes a civil penalty of not more than $100 for willful violations of this requirement.

Applies to schools described in Education Law Section 5001, paragraph F, established primarily to provide instruction to children under age 16.

Takes effect immediately upon enactment.
