Licensed brewers may obtain a permit to serve small samples of beer or malt beverages at outdoor or indoor gatherings, functions, occasions or events for a $20 fee.

Permit is valid for a period not to exceed three days and tastings must occur during hours when alcoholic beverages may be lawfully sold in the community where the event is held.

Each sample serving is limited to three ounces or less, and no consumer of legal age may receive more than two servings per brand offered for tasting.

Samples must be served only by the brewer or its employees, and the brewer is responsible for ensuring samples are only provided to individuals legally eligible to consume alcohol in New York.

The permit includes the privilege to sell beer or malt beverages in sealed containers for off-premises consumption, with liability for any claims accruing to the brewer under General Obligations Law sections 11-100 and 11-101.
