Creates a non-profit Physicians and Surgeons Data Collection and Advisory Association requiring all insurers authorized to write personal injury liability insurance and engaged in writing medical malpractice insurance in New York to be members.

Establishes a 7-member governing body for the association with 3 insurer representatives, 1 plan representative, and 3 superintendent-appointed members representing injured parties, physicians and surgeons, and hospitals; includes an independent casualty actuary on the actuarial committee.

Requires members to file statistical reports on medical malpractice premiums and losses at least annually and directs the association to provide the superintendent with rating information by April 1 each year.

Authorizes the superintendent to assess insurance companies up to 0.5% of net direct written premiums on liability insurance to fund the closed medical malpractice insurance pool for policies issued July 1, 2000 through June 30, 2010.

Establishes the Medical Malpractice Insurance Fund in the state comptroller's custody to receive assessment collections and expend monies for claims and expenses related to the closed medical malpractice insurance pool; allows insurers to deduct assessments from gross direct premiums and credit them against other insurance taxes.
