Updates New York's energy conservation construction code to comply with the American Recovery and Reinvestment Act of 2009, requiring residential buildings to meet or exceed the International Energy Conservation Code and commercial buildings to meet or exceed ASHRAE 90.1-2007 standards.

Expands code application to additions and alterations of existing buildings, while exempting specific minor work such as storm window installation, glass-only replacements, and certain reroofing projects that do not increase energy use.

Increases penalty for code violations from a maximum fine of $500 to $1,000 and/or up to 30 days imprisonment.

Requires the State Fire Prevention and Building Code Council to establish annual compliance measurement standards and training requirements for personnel administering and enforcing the energy conservation construction code.

Establishes a 30-day filing requirement for municipalities adopting local energy codes more stringent than the state code, with enforcement authority conditioned on timely notification to the State Fire Prevention and Building Code Council.
