Authorizes the New York State Commissioner of Transportation to lease airspace and unused surface or subsurface land adjacent to state highways for up to 99 years for construction and operation of solar and wind electric generating systems.

Grants county superintendents and town superintendents similar leasing authority for county and town roads respectively, subject to approval by the county governing body and town board.

Permits solar and wind systems to be mounted on sound barriers, retaining walls, parking lots, bridges, signs, and other structures on leased highway property.

Exempts solar and wind electric generating systems from local laws, ordinances, and regulations but subjects them to state and federal law.

Authorizes the Metropolitan Transportation Authority to lease its property for solar and wind electric generating systems under the same 99-year term and conditions, while preserving abutting landowners' rights of access.
