Allows Chester S. Kasprzyk to apply for retroactive membership in the New York State and Local Employees' Retirement System for employment with the Town of Cheektowaga sewer department from July 1, 1975 to 1978.

Grants Kasprzyk Tier II status in the retirement system if he files an application with the State Comptroller on or before December 31, 2010, making him eligible for all associated rights and benefits.

Kasprzyk's prior contributions to the retirement system will not be refunded under this act.

Town of Cheektowaga is responsible for paying all past service costs, estimated at approximately $41,300 as a one-time payment.

Takes effect immediately upon enactment, with an anticipated annual cost increase of approximately $2,400 to Erie County's contributions for fiscal year ending March 31, 2011.
