Establishes separate energy conservation construction codes for residential and commercial buildings, with residential buildings meeting or exceeding the International Energy Conservation Code standards and commercial buildings meeting or exceeding ASHRAE 90.1-2007 standards

Applies the energy code to new building construction, additions, and alterations (including building systems), with specified exemptions for minor work such as storm windows, glass-only replacements, and lighting alterations that do not increase energy use

Expands the definition of "historic building" to include properties listed on or eligible for the National Register of Historic Places, and exempts such buildings from energy code compliance requirements

Authorizes municipalities to adopt local energy conservation codes more stringent than the state code, provided they file such codes with the State Fire Prevention and Building Code Council within 30 days of adoption

Increases the penalty for violating the energy code from a maximum fine of $500 to $1,000, or imprisonment of up to 30 days, effective January 1, 2011
