Establishes separate building energy codes for residential and commercial buildings, with residential buildings required to meet or exceed the International Energy Conservation Code and commercial buildings required to meet or exceed ASHRAE 90.1-2007 standard, or achieve equivalent energy savings

Expands code application to additions and alterations of existing buildings, with specific exemptions for storm windows, glass replacements, reroofing, door replacements, and certain lighting modifications that do not increase energy use

Increases penalty for code violations from $500 to $1,000 in fines and allows imprisonment up to thirty days for knowingly violating code provisions

Requires municipalities filing local energy conservation codes with the state within thirty days to receive enforcement authority; municipalities failing to file cannot enforce local codes without state approval

Authorizes State Fire Prevention and Building Code Council to adopt regulations establishing training requirements, compliance measurement standards, and enforcement procedures for the energy conservation code, effective January 1, 2011
