Requires all officers, employees, and volunteers at facilities contracted with or approved by the Department to submit to random, unannounced drug testing at least twice yearly at facility expense.

Mandates all prospective employees and volunteers pass a drug test administered by the provider before being hired.

Requires drug and alcohol testing within one hour following serious reportable incidents, allegations of abuse, substantial injury, death, or incidents creating risk of substantial injury or death.

Specifies testing procedures including collection of two samples, submission to private forensic laboratory, confirmatory testing by gas chromatography or equivalent method, and preservation of backup sample.

Subjects employees who refuse testing or fail drug tests to immediate suspension without pay and termination; allows employees to submit list of legally prescribed medications prior to testing.
