Requires insurance policies covering prescription fertility drugs to provide equal coverage when drugs are purchased from network participating non-mail order retail pharmacies, provided the pharmacy agrees to the same reimbursement amounts and terms as mail order pharmacies.

Prohibits insurers from imposing additional fees, co-payments, co-insurance, deductibles, or other conditions on insureds who purchase prescription fertility drugs from participating retail pharmacies compared to those who use mail order or non-retail pharmacies.

Applies to policies issued by health insurers, medical expense indemnity corporations, hospital service corporations, and health services corporations.

Exempts policies that are the result of collective bargaining agreements between employers and recognized or certified employee organizations.

Takes effect on the same date as section 5 of Chapter 598 of the laws of 2011.
