Amends Education Law Section 3604 to allow the Commissioner of Education to disregard up to 10 days of missed instruction in the 2011-2012 school year when calculating state aid apportionment if schools were closed due to extraordinary weather, natural disasters, state emergencies, transportation route closures, or utility failures.

Requires the District Superintendent to certify that the missed instructional days cannot be made up by using all scheduled vacation days prior to Regents examinations (first exam day in June for secondary grades, last exam day in June for elementary grades).

Requires the District Superintendent to certify that using scheduled vacation days for instruction would imperil students, faculty, and staff while repairs continue.

Defines "scheduled vacation days" as days when schools are not in session and for which no prohibition exists under Education Law Section 3604(8) for holding classes.

Takes effect immediately upon enactment.
