Requires Committee on Special Education recommendations to include, upon parent request, a determination of the child's ability to learn in any given educational environment, accounting for differences between school and home environments and family background.

Mandates school districts grant or deny tuition reimbursement requests within 90 days of receipt and provide approved reimbursement within 30 days of approval.

Provides that tuition reimbursement for unilateral parental placements approved by settlement agreement, impartial hearing officer, state review officer, or court shall continue until the Committee on Special Education amends or modifies the child's Individualized Education Program.

Takes effect immediately, with amendments to sections 4402 and 4404 of the Education Law set to expire with those respective provisions.
