Requires employers operating schools serving children under age 16 to check the sex offender registry before hiring employees for positions involving direct, unsupervised contact with children.

Mandates that employers inform prospective employees before conducting the sex offender registry inquiry.

Establishes a civil penalty of up to $100 for willful violations of the registry check requirement.

Applies to schools established primarily for providing instruction to children under age 16, as defined in Education Law Section 5001.

Takes effect immediately upon enactment.
