Expands criminal history check requirements to include persons over age 18 residing in family care homes or family-based treatment programs approved on or after April 1, 2011, in addition to employees and volunteers with unsupervised contact with clients.

Requires criminal history checks to include both New York State and national (FBI) criminal history information for covered individuals, with fingerprints submitted for federal background checks.

Establishes mandatory denial of applications or employment for individuals with felony sex offense convictions, felony violence convictions within past ten years, or convictions for endangering incompetent or physically disabled persons; authorizes discretionary denial for other crimes consistent with correction law article 23-A.

Requires authorized agencies to notify providers and subject individuals in writing of criminal history check results and grounds for any denials, including detailed summaries of findings and any pending charges.

Permits temporary approval of applicants pending criminal history check results provided they have no unsupervised contact with clients, with specific procedures for family care homes and family-based treatment providers.
