Authorizes state agencies to require criminal background checks for contractor employees working on critical infrastructure projects, with fingerprints submitted to the Division of Criminal Justice Services and FBI.

The Division of Criminal Justice Services may charge fees for conducting state and national criminal history record checks on contractor employees.

Contractors are responsible for notifying employees about required background checks and obtaining fingerprints in the manner prescribed by the Division.

Requires state agencies to consider whether contractor employees will access critical infrastructure or sensitive security information when deciding to include background check requirements in contracts.

Authorizes the Division of Homeland Security and Emergency Services to require current and transferred employees to undergo state and national criminal background checks, with determinations on criminal convictions made under Article 23-A of the Correction Law.
