Amends Civil Practice Law and Rules Rule 3113(c) to allow a non-party deponent's counsel to participate in depositions and make objections on behalf of the client in the same manner as counsel for a party.

Maintains existing rules that examination and cross-examination of deponents shall proceed as permitted in open court trials, with the added exception for non-party deponent participation.

Preserves the right of a party deponent to be cross-examined by their own attorney when the deposition is taken at the instance of an adverse party.

Takes effect immediately and applies to all actions pending on the effective date or commenced on or after the effective date.
