Department of Transportation must complete an engineering or intersection control study within three months of receiving a request to implement a traffic control device, following National Manual on Uniform Traffic Control Devices standards.

Department must prepare a written report detailing study analyses and explaining any criteria or warrants that were not met; report must be provided to requesters and made available to the public at no cost.

If the department determines no traffic control device is warranted, requesters may appeal to the commissioner within 60 days and submit new data for consideration in a supplementary report.

If the department still denies the request after reviewing new data, the matter goes to an independent advisory board of five members (Deputy Mayor for Public Safety, Police Commissioner, one department appointee, and two city residents appointed by City Council) whose recommendations must be addressed in writing by the commissioner if rejected.

Department must collect accident data from state police reports, public affidavits, and insurance claims data from the State Department of Financial Services when performing studies; department cannot be required to study the same location again for 12 months unless traffic conditions have changed significantly.
