Establishes an affirmative defense for licensees charged with selling alcoholic beverages to persons under 21 if the licensee held a valid alcohol training awareness program certificate and diligently implemented the program's provisions.

Creates an additional defense prohibiting proceedings against licensees who: (1) have an operating device capable of reading electronically readable identification formats; (2) require employees to conduct transaction scans of all age identification before every sale; (3) hold a valid alcohol awareness program certificate; and (4) had no violations under this section on the premises within the previous two years.

Requires licensees asserting the affirmative defense to prove each element by a preponderance of credible evidence, with three unlawful sales by any employee within two years considered as evidence of failure to diligently implement the training program.

Takes effect on January 1st following enactment.
