Authorizes school districts to contract with approved alternative institutional support services programs to provide instructional and support services to at-risk special education and non-special education students.

Districts pay approved programs the actual cost of services including administrative, instructional, operating and support expenses proportionate to student attendance, while students continue to be counted toward the district's federal and state aid.

Allows districts to contract with approved programs to serve as interim alternative educational settings for disciplinary placements as defined under the federal Individuals with Disabilities Education Improvement Act.

Requires the Commissioner of Education to process applications and maintain a list of approved programs, which must be not-for-profit, non-sectarian, employ certified personnel, and demonstrate a minimum of ten years of improved student performance for at-risk students.

Takes effect immediately upon enactment.
