Deems Tamara Hemminger a member of the New York State and Local Employees' Retirement System effective December 17, 2009, granting her retroactive Tier IV status due to an administrative error in processing her application.

Hemminger was employed by the Department of Labor as a labor services representative on December 7, 2009, and filed her membership application on December 17, 2009, which was not processed due to reasons not attributable to her negligence.

The state of New York shall bear all past service costs associated with implementing this retroactive membership, estimated at approximately $2,280 as a one-time payment.

The Canandaigua City School District (Hemminger's current employer) will incur increased annual retirement contributions of approximately $1,500 for the fiscal year ending March 31, 2013.

The act takes effect immediately upon enactment.
