Prohibits unlicensed persons from shipping cigarettes to New York state residents, with limited exceptions for licensed tax agents, wholesale dealers, export warehouse operators, and government officials acting in official capacity.

Requires common or contract carriers to avoid transporting cigarettes to non-authorized recipients, with a presumption that delivery to a home or residence indicates an unauthorized recipient.

Allows registered retail dealers and non-carrier persons to transport up to 800 cigarettes at one time without violating the law.

Increases civil penalties for violations to the greater of $5,000 per violation or $100 per pack of cigarettes shipped or transported illegally.

Grants the Attorney General and corporation counsel of political subdivisions that impose cigarette taxes authority to bring enforcement actions and retain resulting civil penalties.
