Requires the commissioner of the Office for People with Developmental Disabilities to promulgate regulations mandating criminal history reports for any prospective employee or volunteer who will have regular direct patient contact.

Authorizes the denial or disapproval of employment or volunteer applications for positions with regular direct patient contact if the criminal history report reveals a conviction for any offense the commissioner determines would make the applicant unfit for employment.

Exempts criminal history reports conducted pursuant to Mental Hygiene Law Section 13.19 regulations from the fee requirements imposed by the Division of Criminal Justice Services, eliminating search and report fees for these background checks.
