Establishes marketing standards for Energy Services Companies (ESCOs) selling electricity or natural gas to residential and small non-residential customers in New York State.

Requires ESCOs and their marketing representatives to provide caller identification, explain the purpose of calls, obtain independent third-party verification before enrollment, and prohibit claiming affiliation with distribution utilities.

Mandates each distribution utility establish an ESCO Marketing Opt-Out Registry and prohibits ESCOs from marketing to customers enrolled on the registry; utilities must provide annual notices explaining how customers can enroll.

Authorizes the Public Service Commission to assess civil penalties up to $1,000 per violation against ESCOs that knowingly fail to comply, with each day of continuing violation treated as a separate offense.

Takes effect 90 days after enactment, with the Public Service Commission authorized to adopt implementing rules and regulations prior to the effective date.
