Repeals section 95-e of the state finance law and establishes a new section 95-h creating the "New York State Prostate Cancer Research, Detection and Education Fund" under joint custody of the Commissioner of Taxation and Finance and the Comptroller.

Fund revenues come from tax law sections 209-E and 630 (voluntary contributions on corporate and personal income tax returns), legislative appropriations, grants, gifts, bequests, and interest earned on deposited funds.

State must appropriate annually an amount equal to voluntary contributions collected in the preceding calendar year, as certified by the Comptroller.

Comptroller must certify to state leadership by February 1st each year the total deposits from voluntary contributions and other sources in the prior calendar year.

Fund monies may only be expended for prostate cancer research, detection, and education projects approved by the Department of Health, with Commissioner of Health ensuring funds are spent within the fiscal year they are received.
