Amends Education Law Section 3205 to authorize the Utica city school district board of education to require minors who are five years old on or before December 1st to attend kindergarten instruction.

Adds Utica to the list of school districts already authorized to impose mandatory kindergarten attendance, alongside Syracuse, New York City, and Rochester.

Provides exceptions allowing parents to elect not to enroll their children in school until the following September and exempts students enrolled in non-public schools or home instruction.

Takes effect immediately upon enactment.
