Removes the seasonal limitation on state liability for highway defects, making the state liable year-round instead of only between May 1 and November 15.

Establishes that the state is liable for damages from highway defects maintained under the commissioner of transportation's system, provided the state received actual or constructive notice of the defects.

Clarifies that the state maintains and is liable only for the width of pavement it constructed or improved within incorporated village limits, determined by the centerline shown on department of transportation plans.

Excludes bridges from state liability when the state has no control over them.

Takes effect immediately and applies to all causes of action accruing on or after the effective date.
