Health maintenance organizations, insurers, and health service corporations cannot refuse premium or cost-sharing payments from third parties on behalf of individual market enrollees or subscribers.

Eligible third-party payers include Indian tribes, tribal organizations, urban Indian organizations, state or federal government programs or grantees (such as the Ryan White HIV/AIDS Program).

Private, not-for-profit foundations may make third-party payments on behalf of enrollees who meet defined criteria based solely on financial status and do not consider health status, provided the payment covers the entire policy year.

Applies to insurance policies and contracts offered through the individual market.

Takes effect January 1, 2015.
