Amends Penal Law Section 241.05 to rename harassment of a rent regulated tenant as "in the first degree" and maintains it as a class E felony for causing physical injury with intent to vacate.

Creates new Penal Law Section 241.03 establishing harassment of a rent regulated tenant "in the second degree" as a class A misdemeanor when an owner intentionally impairs habitability or creates/maintains conditions endangering tenant safety or health with intent to cause vacating.

Takes effect immediately but expires and is repealed in accordance with the sunset provisions of Article 241 of the Penal Law under Chapter 116 of the laws of 1997.
