Adds new subdivision 5 to Penal Law Section 250.45 to criminalize intentional use or installation of imaging devices to surreptitiously view, broadcast, or record a person engaging in sexual conduct or in contact with intimate parts of another person without consent and when the person has a reasonable expectation of privacy.

Expands the definition of unlawful surveillance in the second degree to include recording for amusement, entertainment, profit, sexual arousal, gratification, or degradation purposes in addition to existing provisions regarding viewing under clothing.

Modifies Penal Law Section 250.55 to clarify that dissemination of unlawful surveillance images is a class A misdemeanor when the underlying unlawful conduct satisfies elements of either unlawful surveillance in the first or second degree.

Updates Penal Law Section 250.60 to expand the sale or publication offense to include both first and second degree unlawful surveillance conduct rather than only first degree.

Takes effect on November 1 following the date the bill becomes law.
