Amends penal law section 165.74 to permit distribution of seized counterfeit goods to charitable organizations for free distribution to the needy after permanent alteration of the items.

Requires that counterfeit goods be permanently altered so they cannot be mistaken for authentic items by the general public or retail merchants before distribution is allowed.

Maintains existing procedures for seizure by police officers and magistrate's determination of probable cause within 48 hours after arraignment.

Preserves the requirement that counterfeit goods be destroyed upon defendant's conviction, but clarifies destruction may include charitable distribution of altered items rather than only destruction or disposal.

Takes effect immediately upon enactment.
