Expands nebulizer availability in schools to allow students with asthma or respiratory diseases to self-administer inhaled medications during school days, on school property, and at school functions with written physician authorization and parental consent.

Requires school districts, BOCES, and non-public schools to maintain nebulizers in working order and make them available to students with patient-specific orders requiring nebulizer administration by a school nurse, physician, or other licensed professional.

Permits school districts, BOCES, and non-public schools to optionally provide nebulizers on school property and at school functions for student self-administration of prescribed inhaled medications.

Requires written physician or healthcare provider permission to include attestation that the student is diagnosed with asthma or respiratory disease and has demonstrated ability to effectively self-administer nebulizer medications, including medication name, dose, timing, and circumstances for use.

Provides legal and financial immunity to school districts, BOCES, non-public schools, and their agents or employees for harm or injury resulting from reasonable and good faith compliance with the law.
