Authorizes cities with population of one million or more to include work maintaining, supporting, protecting, or accommodating private energy, telecommunications, or other facilities in public work contracts when such facilities are located within, adjacent to, or traversing the construction area.

Allows removal, relocation, alteration, replacement, reconstruction, or improvement of private facilities to be deemed public work for contracting purposes if costs are not borne by the city, except as provided by Chapter 357 of the Laws of 1988.

Amends General Municipal Law Section 103 to apply this provision to cities with one million or more inhabitants while maintaining existing contracting requirements for lowest responsible bidder on public work expenditures exceeding $35,000.

Takes effect immediately with provisions made for expiration and reversion of amendments based on Section 41 of Part X of Chapter 62 of the Laws of 2003.
