Prohibits school districts and boards of cooperative educational services from administering standardized state assessments, vendor-developed assessments, or comparable standardized assessments to students in kindergarten through grade two in teacher performance review plans, except for diagnostic purposes or assessments required by federal law.

Allows only locally developed assessments for students in kindergarten through grade two, defined as district, BOCES, or regionally developed assessments that are rigorous and comparable across classrooms; excludes vendor or third-party developed assessments.

Directs the commissioner of education to reject any annual professional performance review plans that violate the restrictions on standardized assessments for younger students.

Prohibits the administration of state-developed and vendor-developed standardized student assessments in prekindergarten programs except for diagnostic purposes.

Takes effect immediately, with the commissioner authorized to issue necessary rules and regulations; does not apply to performance review agreements already in effect under prior collective bargaining agreements.
