School districts closed due to emergencies during Regents examination periods must provide affected students an opportunity to retake missed exams within 30 days of the original examination date.

The Board of Regents is responsible for selecting make-up examination dates and notifying school districts of the rescheduled dates and testing locations.

"Emergency" is defined as a situation that poses an immediate risk to health, life, or property and causes a school district to close.

Applies to all students qualified to take Regents exams as specified in 8 NYCRR 8.2.

Takes effect immediately upon enactment, with required regulatory changes to be completed by the effective date.
