Restores "medical futility" as a standard for do not resuscitate (DNR) orders under the Family Health Care Decisions Act and Surrogate's Court Procedure Act, which superseded the former DNR law in 2010.

Allows DNR orders when two physicians independently determine that resuscitation would be unsuccessful in restoring cardiac and respiratory function or the patient will experience repeated arrest before death.

Applies the medical futility standard to patients with surrogates and to patients lacking decision-making capacity who have no surrogate, including developmentally disabled patients.

Permits DNR orders based solely on medical futility without requiring findings that treatment would impose an extraordinary burden on the patient.

Takes effect 90 days after becoming law.
