Establishes marketing standards for Energy Services Companies (ESCOs) selling electricity or natural gas to residential and small non-residential customers in New York State.

Requires ESCOs to obtain independent third-party verification before enrolling customers, remove customers from marketing databases upon request, and disclose the ESCO representative's name, ESCO identity, and call purpose.

Mandates each distribution utility establish an ESCO Marketing Opt-Out Registry and prohibits ESCOs from marketing to customers enrolled in the registry via telephone or other means.

Authorizes the Public Service Commission to assess civil penalties up to $1,000 per violation against ESCOs that knowingly fail to comply, with each day of a continuing violation counted as a separate offense.

Takes effect 90 days after becoming law, with the Public Service Commission authorized to promulgate rules and regulations necessary for implementation before the effective date.
