Susan Kupferman is deemed eligible for a service retirement benefit effective September 17, 2013 (her 55th birthday), despite dying on June 26, 2013, based on over 30 years of public service with the Metropolitan Transportation Authority.

Her spouse may file for the service retirement benefit on her behalf with the New York State and Local Employees' Retirement System on or before December 31, 2014.

Benefits shall be paid according to Susan Kupferman's option election form from her Article 15 disability retirement application, with all prior payments deducted from future benefit amounts.

Filing for service retirement constitutes a withdrawal of any disability retirement application and waives all rights to disability benefits, post-retirement death benefits, and ordinary death benefits under sections 508 or 606 of the Retirement and Social Security Law.

The legislation is estimated to cost the Metropolitan Transportation Authority approximately $403,000 as a one-time expense, with payment expected February 1, 2015.
