Allows persons previously convicted of criminal possession of marijuana in the fifth degree to petition for expungement of records after two years from conviction, completion of probation/parole, and payment of fines or restitution.

Petitioner must have no prior or subsequent convictions in New York, another state, or by the United States to be eligible for expungement.

Petition must be filed with the Supreme Court or County Court in the county of conviction and served upon the district attorney, state police, local police, and the sentencing judge.

Court may grant expungement order within 90 days if no objections are received from law enforcement agencies and petitioner is not disqualified.

Petition must include petitioner's date of birth and arrest, original indictment or complaint, certificate of disposition, and name of sentencing judge, all verified under penalty of perjury.
