Department of Social Services must permit social services districts to submit evidentiary packages for fair hearings in electronic format and provide means to facilitate their use at the hearing.

Submission of evidence in electronic format is optional; social services districts are not required to use electronic submission and parties may still offer paper documentation as evidence.

When a person entitled to appeal requests a paper copy of the evidentiary package either before or at the hearing, the social services district must provide it regardless of the format used for the hearing presentation.

The Department must notify individuals entitled to appeal that they may request orally or in writing a paper copy of the evidentiary package to be presented by the social services district at the fair hearing.

The act takes effect sixty days after becoming law.
