Requires the commissioner of the Office for People with Developmental Disabilities to promulgate regulations mandating criminal history reports for all prospective employees and volunteers with regular direct patient contact.

Authorizes the commissioner to deny or disapprove employment or volunteer applications for positions involving regular direct patient contact if the criminal history report reveals a conviction the commissioner determines makes the applicant unfit for employment.

Exempts criminal history report searches conducted under Mental Hygiene Law Section 13.19 regulations from fees charged by the Division of Criminal Justice Services.

Allows the division to charge fees up to $25 plus an additional $50 surcharge for criminal history searches related to employment or licensing applications, with surcharge revenues split between the general fund and fingerprint identification technology account.
